Summary of Coverage
Gutters Are Us LLC (“Company”) stands behind the products we install and the work we do. This Limited Warranty provides two types of coverage for the original installation described above:
- Limited Lifetime Warranty on Materials – covers defects in the materials supplied and installed by the Company.
- Two (2) Year Warranty on Craftsmanship and Labor – covers defects in the quality of our installation work for two years from the installation date.
1. Limited Lifetime Warranty on Materials
What is covered. For as long as the original purchaser owns the property where the products were installed, the Company warrants that the gutters, downspouts, gutter guards, end caps, elbows, hangers, and related components supplied by the Company will be free from defects in material. Covered material defects include:
- Cracking, splitting, or rust-through or corrosion perforation of the material under normal use.
- Peeling, flaking, or blistering of the factory-applied paint finish.
- Failure of gutter guard components, such as warping or separating from the frame, due to a manufacturing defect.
What we will do. If a covered material defect is confirmed, the Company will repair the defect or supply replacement material of the same or comparable type and color, at the Company’s option. Where an exact color or style match is no longer available, the Company will supply the closest available equivalent.
Labor on material claims.
- During the first two (2) years after installation, replacement labor is provided at no charge, as described in Section 2.
- After the first two (2) years, the Company will supply replacement material at no charge, and the owner is responsible for the cost of removal and installation labor. The Company will provide that labor at its then-current rates if requested.
2. Two (2) Year Warranty on Craftsmanship and Labor
What is covered. For two (2) years from the installation date, the Company warrants that its installation work will be free from defects in workmanship. Covered workmanship defects include:
- Leaks at seams, corners, end caps, or downspout connections caused by faulty installation or sealant failure.
- Gutters that sag, pull away from the fascia, or detach because of improper hanger spacing or fastening.
- Improper pitch that causes standing water, where the gutter was installed on a sound fascia.
- Loose, disconnected, or improperly secured downspouts.
- Improper installation of gutter guards.
What we will do. The Company will return and correct the defective work at no charge to the owner, including all labor and any materials needed to complete the repair.
3. What Is Not Covered
This warranty does not cover problems caused by or related to:
- Clogging and debris. Leaves, needles, seeds, shingle grit, moss, ice, or other debris. Gutter guards reduce but do not eliminate the need for periodic cleaning and inspection.
- Ice dams and snow or ice loads. Damage caused by ice dams, sliding snow or ice, or excessive snow or ice accumulation.
- Weather and acts of nature. Storms, hail, high winds, lightning, flooding, fallen trees or limbs, fire, earthquake, or other events outside the Company’s control.
- Roof and structural conditions. Roof design, roof leaks, inadequate roof drainage, overflow from heavy rainfall exceeding the system’s capacity, or defects in the fascia, soffit, sheathing, or framing, including rot or deterioration that existed before or developed after installation.
- Alteration or repair by others. Work done to the gutter system by anyone other than the Company, or damage from ladders, tools, roof work, or other contractors.
- Misuse, abuse, or lack of maintenance. Including walking on or leaning objects against the system, or failure to keep the system reasonably clean and maintained.
- Normal wear and cosmetic changes. Fading, chalking, dulling, scratches, dents, denting from impact, or weathering of the finish that does not affect performance.
- Surface runoff and grading. Water pooling, erosion, or basement or foundation water problems. Gutters manage roof runoff only and are not a drainage or waterproofing system.
- Third-party materials. Products not supplied by the Company, or materials the customer provided or required the Company to use.
- Unpaid balances. This warranty is valid only if the invoice for the work has been paid in full.
- Downspout Extensions. DOWNSPOUT EXTENTIONS that are a piece of downspout that run from the bottom elbow out into the yard.
4. Who Is Covered
This warranty is extended to the original purchaser and applies only to the property address listed above.
- The materials warranty is valid for as long as the original purchaser owns the property.
- The craftsmanship and labor warranty is valid for two (2) years from the installation date.
- This warranty may be transferred one time to a subsequent owner of the property if the Company is notified in writing within 30 days of the sale. A transferred warranty covers materials only.
5. How to Make a Warranty Claim
- Contact us promptly after discovering a problem, by phone at 217-417-7617 or by email at gutters@seamlessgutters.tv.
- Provide your name, property address, installation date or invoice number, a description of the problem, and photos if possible.
- Allow inspection. The Company may inspect the property to verify the claim. Please provide reasonable access.
- Resolution. If the claim is covered, the Company will schedule the repair or replacement within a reasonable time, weather and material availability permitting.
Please keep your invoice and this warranty. Proof of purchase may be required.
The Company is not responsible for damage that worsens because a problem was not reported within a reasonable time after it was discovered.
6. Limitations
Remedies. The Company’s sole obligation under this warranty is to repair or replace defective materials or workmanship as described above. Where permitted by law, the Company will not be liable for incidental or consequential damages, such as interior water damage, damage to landscaping, or loss of use, resulting from a defect or from any breach of this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion may not apply to you.
Implied warranties. To the extent allowed by law, any implied warranties on these products or this work are limited to the duration of the applicable express warranty above. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.
Maximum liability. In no event will the Company’s liability exceed the original price paid for the affected portion of the work.
Your legal rights. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
Manufacturer warranties. Where a product manufacturer provides its own warranty, that warranty is in addition to this one, and the Company will help you submit a claim to the manufacturer on request.
7. Governing Law
This warranty is governed by the laws of the State of Illinois.
